Leicestershire County Council and the Leicester, Leicestershire and Rutland Combined Fire Authority (CFA) require up to six independent people to support them in promoting and maintaining high standards of conduct by Councillors, other people serving on the County Council and CFA bodies and Senior Chief Officers of the County Council and the CFA. Under the Localism Act 2011, the Council and CFA have adopted a Members’ Code of Conduct, which reflects the Nolan Principles of Public Life.
The role of the Independent Persons will be:
(i) To give views on complaints where there is an allegation that a Councillor has failed to comply with the Code of Conduct before a decision is taken on what to do and before any decision is reached where there is an investigation. The Independent Person may be asked at any stage of the process to give their views on the complaint by the Council’s or the CFA’s Monitoring Officer, Member Conduct Panel and/or the Councillor who is the subject of the complaint.

(ii) To sit on a Panel (consisting of 3 Independent Persons) which would be established in circumstances when it is proposed, following an investigation, that a Senior Chief Officer (i.e. for the Council - the Chief Executive, the Chief Finance Officer or the Monitoring Officer and for the CFA – the Chief Fire and Rescue Officer, the Treasurer or Monitoring Officer) be dismissed. The Independent Persons on the Panel will be asked to give their advice, views and/or make recommendations on the proposed dismissal. (The decision to dismiss would be taken by the County Council or the Combined Fire Authority having regard to comments made by the Panel.)
Applications are invited from people who are able to demonstrate that they have:
  • A working knowledge/interest in/experience of local government or some other aspects of public service and of the political process.
  • A strong commitment to high standards and ethics in public life and to the general principles governing the conduct of members and officers and matters of probity and integrity.
  • Enthusiasm to develop a sound understanding of the ethical and regulatory framework relating to member standards.
  • The ability to analyse complex situations, assimilate information/evidence quickly, understand legal requirements and apply them in specific circumstances.
  • The ability to take a fair, open-minded and objective viewpoint and arrive at balanced judgements based on evidence.
  • The ability to communicate effectively and operate in co-operation with others.
Working hours will generally be flexible but there may be a requirement to attend meetings during the day and in the evening and to be available for telephone or email consultation, sometimes at short notice.
The appointment will be for a fixed term of 4 years. The role is not salaried but travel and subsistence allowances will be payable.
Please note, the Council and CFA cannot appoint anyone who is or has been an elected or co-opted member or officer of either Authority during the last five years, or its Parish Councils, or who is a relative or close friend of such persons. In addition, the Council and the Combined Fire Authority are not prepared to appoint anyone who is actively engaged in local party-political activity.
